We work closely with your lender or broker to review instructions, confirm conditions, and prepare all required documents. Once everything is ready, we’ll schedule your signing appointment, explain the mortgage terms in plain language, and make sure you understand exactly what you’re agreeing to. We can coordinate signings in office, or we can come to you, to maximize convenience. (Estate documents all have to be signed in person, so we are unable to provide virtual or remote signings, but we do mobile hospital and home visits, for a fee)
What to Expect During the Process
Mortgage financing comes with paperwork, deadlines, and legal requirements — and it’s completely normal to have questions. Here are some of the most common ones we hear.
Lenders require a lawyer (or notary) to prepare, review, and register the mortgage at the BC Land Title Office. We ensure the new mortgage is properly secured and that any existing mortgage is paid out and discharged.
You should contact us as soon as your lender or mortgage broker confirms your approval. Early involvement helps ensure your mortgage funds are available on time.
We:
- Receive instructions from your lender
- Prepare and review your mortgage documents
- Register the new mortgage
- Pay out and discharge your existing mortgage (if applicable)
- Transfer any remaining funds to you, if available
We typically require:
- Government-issued photo ID
- Property details
- Current mortgage information (if refinancing)
- Banking details for any funds being advanced to you
Most refinances take about one to two weeks once we receive complete instructions from your lender.
Yes. Costs may include:
- Legal fees and disbursements
- Land Title registration fees
- Title insurance (if required by the lender)
- Mortgage discharge fees from your existing lender
- Possible prepayment penalties (check with your lender)
- Your company must be in good standing
- We may need to access your corporate records
- If there are multiple shareholders, all may need to be present to sign documents, depending on the signing authority
- Directors and Shareholders may also need Independent Legal Advice, if guaranteeing a company debt
- Any down payment, deposit, sale proceeds, payout, may need to come from or go into your business bank account. We will clarify this once we review the documents.
If your new mortgage amount is higher than your existing mortgage and related costs, the remaining funds will be provided to you after completion. Funds are provided to you by: lawyer’s trust cheque, deposit into your account, or wire transfer. We are not able to provide you with a certified cheque or bank draft as they are not permissible under the law society’s trust accounting rules.
In many cases, we offer remote signing options. However, some documents may require original signatures or identity verification under BC Land Title requirements. Please let us know right away if you have special circumstances that require accommodation.
BC Land Title rules require valid government-issued photo identification so we can verify your identity before completing your mortgage transaction.
Common delays include:
- Late or incomplete instructions from the lender
- Missing identification or documents
- Title issues that must be resolved before registration
Yes. We coordinate directly with your lender and mortgage broker to ensure the mortgage funds are advanced and registered on time.
We confirm your new mortgage has been registered, your previous mortgage has been discharged (if applicable), and we provide a final reporting package for your records.
