Transferring Property Title the Right Way
When ownership of a property changes, the title has to be legally updated — and that process is called a title transfer. This can happen for many reasons, like buying or selling a home, transferring property between family members, or inheriting a property after someone passes away.
Title transfers involve more than just paperwork. The property’s legal history needs to be reviewed, the correct documents prepared, and everything properly registered with the Land Title Office. At Alpine Legal Services, we handle the entire process to make sure the transfer is completed correctly, legally, and without unnecessary delays. Our goal is to make sure your ownership is properly recorded and fully protected.
What You Need to Know Before Transferring Title
If you’re transferring property ownership, it’s normal to have questions. Here are some of the most common ones we hear.
A property transfer is a change in legal ownership that is registered at the BC Land Title Office. Transfers can occur with or without a sale and may involve adding or removing an owner, transferring property between family members, or moving property into or out of a corporation.
Common situations include:
- Adding or removing a spouse or family member from title
- Transferring property due to separation or divorce
- Estate or inheritance transfers
- Transferring property into or out of a corporation or trust
- Gifting property to a family member
Yes. Even if the transfer is a gift or part of a family arrangement, legal documents must be properly prepared and registered to ensure ownership is transferred correctly.
Property Transfer Tax may apply unless a specific exemption is available. Common exemptions may apply to certain transfers between spouses, pursuant to a separation agreement, or in limited family situations. We will review your circumstances and advise you on any available exemptions.
Yes. We prepare the required documents, explain ownership options (such as joint tenancy or tenants in common), and ensure the change is properly registered.
We typically require:
- Government-issued photo ID for all parties
- Property details
- The reason for the transfer
- Mortgage information (if there is an existing mortgage)
- Any relevant agreements (such as a separation agreement)
If a mortgage is registered, the lender’s consent may be required before the transfer can be completed. In some cases, the mortgage may need to be refinanced or replaced.
Simple transfers can often be completed within one to two weeks once all required information and any lender approvals are received.
In many cases, we offer remote signing options. However, some documents may require original signatures or identity verification under BC Land Title requirements. Please let us know right away if you have special circumstances that require accommodation.
BC Land Title rules require valid government-issued photo identification so we can verify your identity before completing the transfer.
Costs may include legal fees, Land Title registration fees, and Property Transfer Tax (if applicable). We will provide a clear estimate based on your situation.
We register the transfer at the Land Title Office and provide a reporting package confirming the updated ownership for your records.
