While an EPA is most commonly in place to take care of you if you become ill or incapable, there are many other circumstances where an EPA could come into play. If you will be out of country, and unable to take care of your financial or legal matters, you can appoint a trusted person to handle these matters on your behalf.
Another situation is when you are unable to sign real estate transaction documents, and wet ink signatures are required. In this case as well, you can prepare a limited Power of Attorney to give authority to a trusted person to sign the documents on your behalf. EPAs can be drafted to your exact and limited needs, to ensure that a person with authority takes care of only those matters that you appoint to them, on your behalf, whether you are travelling, working, or otherwise detained.

A lawyer ensures your EPA meets BC legal requirements and works when it’s needed. A POA that is not prepared and witnessed by a lawyer may also not be usable for land title purposes.
Documents such as a Will, Power of Attorney, and Representation Agreement must be prepared directly by the person whose estate is being planned—not by family members on their behalf.
